Senator Julie Quinn - District 6

Homeowner Action Urged

As one lawyer explained:

Chinese drywall manufacturer Knauf Plasterboard (Tianjin) Co., Ltd ("KPT") has agreed to accept service of an "Omnibus Class Action Complaint" for a period of one month. Without this agreement, homeowners would have had to serve KPT under the Hague Convention, which is very costly and time consuming. KPT has waived its rights for one month only to assist in the consolidation and efficient handling of claims by affected homeowners. In light of this development, it is imperative that homeowners find out whether they have KPT drywall in their home as soon as possible. Although the omnibus complaint is styled as a class action, the omnibus complaint has not been certified as a class action. Damages will differ for each homeowner and each homeowner will be able to decide whether to accept or reject any settlement offer. If rejected, the homeowner will have the opportunity to have an individualized determination of damages.
