SENATE BILL NO. 125

BY SENATORS CAIN, SHORT AND GREENE AND REPRESENTATIVES DONELON AND DUPRE

A JOINT RESOLUTION

Proposing to add Article I, Section 3.1 of the Constitution of Louisiana, to allow the legislature to prohibit or limit the sale or provision of alcoholic beverages to and the purchase, possession, or consumption of alcoholic beverages by persons under age twenty-one; and to specify an election for submission of the proposition to electors and provide a ballot proposition.

Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members elected to each house concurring, that there shall be submitted to the electors of the state, for their approval or rejection in the manner provided by law, a proposal to add Article I, Section 3.1 of the Constitution of Louisiana, to read as follows:

3.1. Alcoholic beverages; prohibitions or limitations for persons under the age of twenty-one years

Section 3.1. Notwithstanding any other provision of this constitution to the contrary, the legislature may by law prohibit or limit the sale or provision of alcoholic beverages to and the purchase, possession, or consumption of alcoholic beverages by persons under the age of twenty-one years.

Section 2. Be it further resolved that this proposed amendment shall be submitted to the electors of the state at the congressional general election to be held in 1996. However, this proposed amendment shall not be submitted to the electors if the Louisiana Supreme Court, in its decision on rehearing in the case of Manuel v. State of Louisiana, No. 95-CA-2189, upholds the validity of Acts 1995, No. 639.

Section 3. Be it further resolved that on the official ballot to be used at the election there shall be printed a proposition, upon which the electors of the state shall be permitted to vote FOR or AGAINST, to amend the Constitution of Louisiana, which proposition shall read as follows:

To authorize the legislature to prohibit or limit the sale or provision of alcoholic beverages to and the purchase, possession, or consumption of alcoholic beverages by persons under age twenty-one. (Adds Article I, Section 3.1)
